DMCA Policy
Chicken Diavolo ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us.
This policy outlines the procedures for submitting a DMCA Takedown Notice to Chicken Diavolo if you believe your copyrighted work has been infringed, and for submitting a Counter-Notification if your content has been removed due to an alleged infringement and you believe it was removed in error.
Filing a DMCA Takedown Notice
If you are a copyright owner or an agent thereof and believe that any content hosted on Chicken Diavolo infringes upon your copyrights, you may submit a written DMCA Takedown Notice. To be effective, the notification must be a written communication that includes substantially the following:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: A description of the material that you claim is infringing and its location on the Chicken Diavolo website, sufficient to permit us to locate the material (e.g., a URL).
- Contact information: Your address, telephone number, and email address.
- Good faith belief statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Chicken Diavolo may be found), and that you will accept service of process from the person who provided the original notification of alleged infringement or an agent of such person.
- Physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification
If you believe that your content was removed by mistake or misidentification, you may submit a DMCA Counter-Notification. To be effective, the counter-notification must be a written communication that includes substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Chicken Diavolo may be found), and that you will accept service of process from the person who provided the DMCA Takedown Notice or an agent of such person.

Upon receipt of a valid counter-notification, Chicken Diavolo may restore the removed material after 10 business days, unless the copyright owner files an action seeking a court order to restrain the subscriber from engaging in infringing activity related to the material on Chicken Diavolo's system.
